Welcome to RUNDEPT. The terms "we", "us" and "our" refer to RUNDEPT. RUNDEPT operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). RUNDEPT uses Shopify to support portions of the Services, including ecommerce functionality and transaction processing.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access the Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given consent for any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including browsing our online store or purchasing products we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information.
You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all activity occurring through your account. You may not transfer, sell, assign or license your account to another person.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to provide accurate representations and descriptions of products offered through RUNDEPT. However, colors, appearance and other visual characteristics may differ depending on your device, display settings, photography and lighting.
We do not guarantee that the appearance of a product on your screen will exactly match the physical product you receive.
Product descriptions, availability and other product information may be changed or corrected without notice. We reserve the right to discontinue products and to limit quantities available to any person, geographic region or jurisdiction where permitted by law.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase.
RUNDEPT reserves the right to accept, decline or cancel an order where permitted by law, including in cases involving suspected fraud, pricing or inventory errors, payment issues, product unavailability or other circumstances that prevent us from fulfilling the order.
Your order is not accepted until RUNDEPT confirms acceptance. Payment must be successfully authorized and processed before an order can be fulfilled.
Please review your order carefully before submitting it. We may be unable to accommodate cancellation or modification requests once an order has entered processing or fulfillment.
If we decline, modify or cancel an order, we will attempt to notify you using the contact information provided with the order.

Unless otherwise expressly agreed by RUNDEPT, purchases through our consumer storefront are intended for personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice.
The price charged for a product will be the price displayed at the time the order is placed, subject to correction of obvious pricing errors where permitted by law.
Unless otherwise expressly stated, displayed prices do not include applicable taxes or shipping charges.
Prices offered through RUNDEPT may differ from prices offered by third-party retailers or marketplaces.
Promotions may be governed by additional terms and conditions. If specific promotional terms conflict with these Terms, the specific promotional terms will govern with respect to that promotion.
You agree to provide current, complete and accurate purchase, payment and account information.
You represent and warrant that you are authorized to use the payment method provided and agree to pay all charges associated with your order, including applicable shipping charges and taxes.
SECTION 5 - SHIPPING AND DELIVERY
Shipping and delivery estimates are provided in good faith but are estimates only and are not guaranteed unless expressly stated otherwise.
We are not responsible for delays caused by shipping carriers, weather, customs processing, incorrect or incomplete shipping information supplied by the customer, or events outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address when placing an order.
Additional information regarding shipping charges, delivery estimates and available shipping methods is provided through our website and checkout.
SECTION 6 - RETURNS AND REFUNDS
Eligible returns are accepted within 15 days of delivery.
Items must be new, unworn, unused and returned in their original condition with all original tags, accessories and packaging.
Shoe boxes must be returned in their original condition. Shipping labels, tape or markings must not be placed directly on the shoe box. The shoe box must be placed inside protective outer packaging for return shipment.
Customers are responsible for return shipping costs for standard returns. RUNDEPT does not offer free returns. If RUNDEPT provides a prepaid return label for convenience, the cost of that label may be deducted from the refund.
Original shipping charges are non-refundable except where otherwise required by law or where RUNDEPT determines that an error occurred on our part.
If you receive an incorrect or defective item, please contact us before returning it. Once verified, RUNDEPT will cover the applicable return shipping cost.
Items clearly marked Final Sale are not eligible for return.
We do not offer direct exchanges. Customers seeking another size or item should return the eligible original item and place a new order.
Returns are inspected upon receipt. Once a return has been received, inspected and approved, the refund will be processed to the original payment method within 5 days.
RUNDEPT does not charge a restocking fee for eligible returns.

SECTION 7 - INTELLECTUAL PROPERTY
The Services, including RUNDEPT's original text, graphics, logos, designs, photographs, videos, software, interface elements and other content, are owned by RUNDEPT or used under authorization from their respective owners and may be protected by applicable intellectual property laws.
Product names, brand names, trademarks, logos and other intellectual property belonging to third-party brands remain the property of their respective owners.
These Terms permit you to use the Services for personal, non-commercial purposes only.
You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit RUNDEPT-owned materials except as permitted by law or with our prior written authorization.
Nothing in these Terms grants you ownership of any RUNDEPT, Shopify or third-party intellectual property.
SECTION 8 - OPTIONAL TOOLS
We may provide access to tools, features or services supplied by third parties.
We may not control or monitor these third-party tools and provide access to them on an "as is" and "as available" basis.
Your use of third-party tools may also be governed by the applicable third party's own terms and privacy policies.
We may introduce additional features, tools or resources in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.
SECTION 9 - THIRD-PARTY LINKS
The Services may contain links to websites, resources or services operated by third parties.
We are not responsible for the content, accuracy, availability, policies or practices of third-party websites or services.
If you choose to access a third-party website or service, you do so subject to the terms and policies applicable to that third party.
Questions or disputes concerning products or services purchased directly from a third party should be directed to that third party.
SECTION 10 - RELATIONSHIP WITH SHOPIFY
RUNDEPT uses Shopify, which enables us to provide portions of the Services to you.
However, sales and purchases made through our Store are made directly with RUNDEPT.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and RUNDEPT, including injury, damage or loss resulting from purchased products or services.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to purchases and transactions made with RUNDEPT.
SECTION 11 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Certain information may also be processed by Shopify and other service providers that help us operate our ecommerce services, process payments, fulfill transactions, prevent fraud and provide functionality to customers.
Information may be transmitted to or processed by service providers located outside your state, province or country, subject to applicable privacy laws and contractual safeguards where required.

SECTION 12 - FEEDBACK
If you submit reviews, suggestions, ideas, feedback or other content to RUNDEPT ("Feedback"), you represent that you have the right to provide that Feedback.
You grant RUNDEPT a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute and display Feedback for purposes related to operating, improving and promoting the Services, subject to applicable law.
Feedback must not infringe another person's intellectual property, privacy or other legal rights and must not contain unlawful, abusive, defamatory, obscene or malicious material.
You remain responsible for the accuracy and legality of Feedback you submit.
SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, inventory or availability.
We reserve the right to correct errors, inaccuracies or omissions and to update information where appropriate.
Where permitted by law, we may cancel an order affected by a material pricing, inventory or other error. If payment has already been collected for a canceled order, the applicable amount will be refunded.

You may use the Services only for lawful purposes.
You may not use the Services to:
(a) violate applicable laws or regulations;
(b) infringe the intellectual property or other rights of RUNDEPT or another person;
(c) transmit malicious code, viruses or harmful technology;
(d) attempt unauthorized access to our systems, accounts or infrastructure;
(e) interfere with the security or operation of the Services;
(f) collect personal information about others without authorization;
(g) transmit spam, phishing messages or fraudulent communications;
(h) impersonate another person or entity;
(i) submit false or misleading information;
(j) scrape, extract or systematically collect protected content or data in violation of applicable law, our technical restrictions or these Terms; or
(k) use the Services in a manner that could damage RUNDEPT, our customers, service providers or other users.
We may restrict or terminate access to the Services if we reasonably determine that these Terms have been violated.
SECTION 15 - AUTOMATED AGENTS
Automated or semi-automated software, including AI agents, bots and similar systems, may not circumvent security controls, CAPTCHAs, access restrictions, rate limits, robots directives or other technical measures used to protect the Services.
Automated systems must not conceal their automated nature when identification is reasonably required by the Services.
We reserve the right to limit or block automated access where necessary to protect the Services, customers, infrastructure, content or data.
SECTION 16 - TERMINATION
We may suspend or terminate access to the Services where permitted by law, including in response to violations of these Terms, fraud, abuse or security threats.
Termination does not eliminate obligations or liabilities that arose before termination.
Provisions that by their nature should survive termination, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification and governing law, will continue to apply.
SECTION 17 - DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
EXCEPT AS EXPRESSLY PROVIDED BY RUNDEPT OR REQUIRED BY LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE OPERATION OF THE SERVICES.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, RIGHTS OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
SECTION 18 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RUNDEPT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THIS MAY INCLUDE LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR SIMILAR DAMAGES.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
SECTION 19 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless RUNDEPT and its affiliates, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, liabilities, damages and reasonable costs arising from your material violation of these Terms, violation of applicable law, or infringement of another person's rights.
SECTION 20 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in full force and effect.
SECTION 21 - WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with policies incorporated by reference, constitute the agreement governing your use of the Services, subject to any additional terms expressly applicable to particular products, promotions or services.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
RUNDEPT may transfer or assign its rights and obligations where permitted by applicable law.

These Terms and any separate agreements through which RUNDEPT provides Services will be governed by applicable federal law and the laws of the state in which RUNDEPT is headquartered, without limiting any mandatory consumer protections that may apply to you under applicable law.

The most current version of these Terms of Service will be available through our website.

Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
